Data protection
Privacy Policy - The Basics
A privacy policy is a statement that discloses some or all of the ways in which a website collects, uses, discloses, processes, and manages the personal data of its visitors and customers. It typically also includes a statement of the website's commitment to protecting the privacy of its visitors or customers and an explanation of the various mechanisms the website implements to protect privacy.
Different legal systems have different requirements for the content of a privacy policy. Website operators are therefore responsible for complying with the relevant legislation for their activities and location.
This privacy policy explains which personal data Move with Ela processes, for what purpose, to whom it is disclosed and what rights you have. It is based on the Swiss Federal Act on Data Protection (FADP) and, where applicable, the EU General Data Protection Regulation (GDPR).
1. Controller
The controller responsible for data processing is:
Move with Ela, owner Ela (Michaela) Selg
Freigutstrasse 36
8001 Zürich
Switzerland
Email: move_with_ela@gmx.ch
Please send any data protection enquiries by email or post to this address. Move with Ela has not appointed a data protection advisor, as this is not required by law.
2. Scope and Principles
This policy applies to the website move-with-ela.ch and to all data processing in connection with personal training, athletic training and coaching – on site, outdoors or online.
Personal data means any information relating to an identified or identifiable person. Processing covers any handling of such data, for example collecting, storing, using, disclosing or deleting it.
Move with Ela only processes the data necessary for the respective purpose and only for as long as necessary. Processing is carried out transparently, proportionately and for specific purposes.
3. What Data Is Processed and Why
3.1 Contact
If you get in touch by email, phone, contact form or Instagram message, your details (e.g. name, email address, phone number, content of your message) are processed in order to respond to your enquiry. The contact form on the website runs on Wix Forms, Wix's in-house solution; the information is stored in Move with Ela's Wix account. Email communication is handled by the provider GMX (1&1 Mail & Media GmbH, Germany).
3.2 Appointment Booking
Wix Forms is also used for booking the free consultation and sessions. In this process, your name, email address, preferred appointment and any other details entered in the booking form are processed and stored in Move with Ela's Wix account.
3.3 Training and Coaching
To deliver training, coaching, session packages and monthly packages, the following data in particular is processed: name, address, email address, phone number, date of birth, booked services, appointments, billing and payment details (bank transfer or TWINT) and correspondence. This data is needed to perform the contract, schedule appointments and comply with statutory retention obligations.
3.4 Health Data, Tests and Training Data
To ensure that training and coaching are safe and effective, information about your health may be processed depending on the service, for example from an initial assessment or health questionnaire: injuries, complaints, pre-existing conditions, medication, sleep, nutrition, perceived stress and diagnoses such as ADHD, if you choose to share them. This also includes results of performance and movement tests, training logs and notes from coaching sessions.
This data is considered sensitive personal data. It is only collected with your explicit consent, used exclusively for your training and coaching, and not disclosed without your consent – including to doctors, physiotherapists or performance testing centres. Providing this information is voluntary; without it, training may not be tailored to you to the same extent. You may withdraw your consent at any time.
3.5 Online Sessions
Online coaching sessions are held via Zoom, Microsoft Teams or WhatsApp video call (providers based in the USA or Ireland; WhatsApp is part of Meta). Your name, email address and technical connection data such as your IP address are processed. Online sessions are not recorded unless you expressly agree.
3.6 Photos and Videos
Photos or videos may be taken during training for technique and movement analysis. These are used exclusively for your training. They are only published, for example on Instagram or the website, with your separate, explicit consent, which you may withdraw at any time.
3.7 Advertising
The contact details published in the legal notice may not be used to send unsolicited advertising.
4. Website
4.1 Hosting and Server Log Files
The website is built with Wix Studio and hosted by Wix.com Ltd. (Israel); Wix uses servers in the EU and the USA, among other locations. When you visit the website, technical data is collected automatically: IP address, date and time, browser and operating system, pages visited and the previously visited page. This data is used to operate the website securely and reliably and is not combined with other data about you. Wix's privacy policy also applies (https://www.wix.com/about/privacy).
4.2 Cookies
The website uses cookies. These are small text files stored on your device. Technically necessary cookies make the website work. Other cookies, for example for statistics or embedded third-party content, are only set if you consent in the cookie banner.
You can change your choice at any time via the cookie settings on the website. You can also delete or block cookies in your browser; some website features may then be restricted.
4.3 Google Analytics
The website uses Google Analytics, a web analytics service provided by Google Ireland Limited (Ireland) and Google LLC (USA). Google Analytics uses cookies to analyse how the website is used, for example which pages are visited and for how long. IP addresses are shortened in the process. Google Analytics is only activated if you consent in the cookie banner. For more information, see Google's privacy policy (https://policies.google.com/privacy).
4.4 Instagram and LinkedIn
The website includes an embedded Instagram feed and links to Instagram and LinkedIn. When the embedded feed loads, your browser may connect to servers of Meta Platforms Ireland Limited or Meta Platforms Inc. (USA); among other things, your IP address and the page visited are transmitted. If you are logged in to Instagram, Meta can link the visit to your account.
With simple links, data is only transmitted when you click on them. How Meta and LinkedIn (LinkedIn Ireland Unlimited Company) process data is described in their privacy policies: Instagram (https://privacycenter.instagram.com/policy) and LinkedIn (https://www.linkedin.com/legal/privacy-policy).
4.5 Encryption
The website uses SSL/TLS encryption. You can recognise it by the padlock symbol and «https://» in the address bar.
5. Disclosure to Third Parties
Personal data is never sold. It is only disclosed if you have consented, if this is necessary to perform the contract, or if there is a legal obligation.
Recipients may include: service providers working for Move with Ela (website hosting, appointment booking, email, online meetings, accounting and fiduciary services, payment processing via bank and TWINT), insurers, and authorities or courts where required by law. These service providers may only process the data on Move with Ela's behalf and for the specified purposes.
6. Disclosure Abroad
Some service providers process data outside Switzerland, in particular in the EU/EEA, Israel and the USA (Wix, Google, Meta, Zoom, Microsoft). Under Swiss law, the EU/EEA and Israel are considered to provide an adequate level of data protection.
Data is disclosed to the USA to companies certified under the Swiss-U.S. Data Privacy Framework or on the basis of standard contractual clauses as appropriate safeguards. Health data is not disclosed abroad unless the software used stores it there for technical reasons.
7. Retention Period
Personal data is only stored for as long as necessary for the purpose or as required by law. Business records such as invoices and accounting documents are kept for the statutory period of ten years.
Health, test and training data is deleted no later than two years after the last session, unless you request deletion earlier. Enquiries that do not lead to a working relationship are deleted after six months.
8. Data Security
Move with Ela takes appropriate technical and organisational measures to protect your data against loss, misuse and unauthorised access. These include password-protected and encrypted devices and accounts, encrypted transmission and access limited to what is necessary. Paper records are kept locked away.
9. Your Rights
Under the FADP, you have the following rights:
-
Access: what data about you is processed, where it comes from, why and to whom it is disclosed
-
Rectification: have inaccurate data corrected
-
Erasure or restriction: unless a statutory retention obligation applies
-
